Import-export authorisation

The royal decrees of 31/12/30 (PDF, 366.53 Kb) and 22/01/98 (PDF, 227.24 Kb) foresee the possibility of importing or exporting narcotic drugs or psychotropic substances. Each import or export transaction can only take place after receiving specific authorisation from the Narcotic Drugs Department and only used for that transaction.

To receive that document you need to make a request signed by the person in charge or one of his representatives on letterhead of the firm, indicating the address where the transaction takes place, telephone number, fax number, e-mail address and the 6-figure authorisation number.

The fee of 30,63€ per authorisation should be transferred to account number 679-0022038-19 of “AFMPS-FAGG” communicating the annual authorisation number.

For imported or exported narcotic drugs and psychotropic substances that are part of in vitro diagnostic kits, including analytical standards and  reactives marketed for use in laboratories, this fee is not required but the end use must be indicated in the request.

This request must also include the name, address of the firm abroad and the code number of the narcotic drug or psychotropic substance or an exact description of the product to be imported or exported. If it is a salt, indicate the exact type of salt – if it is hydrated, mixed with solvents, the form, the anhydre content: the total quantity in the package should also be indicated as anhydre of the main active ingredient.

For export authorisations the firm should attach the original of the import authorisation from the country to which the goods are to be sent.

After checking the information provided an authorisation is given by the Narcotic Drugs Department.

Import by a pharmacist

Apart from the other regulations in force the royal decrees of 31/12/30 and 22/01/98 foresee the possibility of narcotic drugs and psychotropic substances being imported by practicing pharmacists.

An import can only be transacted after receiving specific authorisation from the Narcotic Drugs Department and intended purely for that import transaction.

To obtain that document one must send a letter on letterhead paper with the name, address, telephone number of the pharmacy and the 6-figure registration number, attaching proof of payment of the 30,63€ per authorisation transferred to account number 679-0022038-19 of  “AFMPS-FAGG”, communicating the registration number. 

The request must also include the name, address of the exporter and an exact description of the product to be imported. If it is a salt, indicate the exact type of salt – if it is hydrated, mixed with solvents, the form, the anhydre content.

After checking the information provided an import authorisation is provided in 5 copies, three of which are for the pharmacist making the request. One copy of the three is for the registry, another for the exporter and a third for the customs authorities.

If it is being imported from a country in the European Union the control of the goods is done at the pharmacy.

If it is from outside the European Union customs clearance must be conducted at the point of entry.

In both cases it is only after customs clearance that the pharmacist can receive the goods at which time he must send the postcard from the department as confirmation of the date of reception..
